Summary

Terms and Conditions of Use (TCU) of The One UN Climate Change Learning Partnership (UN CC:Learn1) e-learning platform, respective e-Learning courses, and materials2

The TCU and the Privacy Policy constitute an “Agreement” between the user3 and the UN CC:Learn regarding the use of any portion of the One UN CC:Learn e-learning platform (UN CC:e-Learn) which consists of all content located within the unccelearn.org web domain, including e-Learning courses, material, or any other services (learning products).

By using the UN CC:e-Learn, the User accept and agree to be legally bound by the Agreement, whether or not you are a registered User. If you do not wish to be bound by the terms of the Agreement, you should not use UN CC:e-Learn:

  1. The learning products offered through UN CC:e-Learn solely have an informative/academic purpose. UN CC:Learn grants permission to Users to visit the UN CC: e-Learn’s and to download and copy the information, documents and materials (collectively, “Materials”) for personal and non-commercial use, or to compile or create derivative works there from, unless stated otherwise. Specific Materials may also be subject to more specific restrictions.

  2. Unless expressly stated otherwise, findings, interpretations and conclusions on the Materials are the expression of staff members, consultants and advisers of the UN CC:Learn Secretariat and its Partners who developed the work. The Materials do not necessarily represent the views of UN CC:Learn, its Partners, the United Nations or its Member States.

  3. Materials are provided “as is” and any expressed or implied warranties, including, but not limited to, the implied warranties of merchantability and fitness for a particular purpose are disclaimed. UN CC:Learn specifically does not make any warranties or representations to the accuracy or completeness of any Materials. UN CC:Learn may periodically change, improve or update the Materials without notice. In no event shall UN CC:Learn be liable for any direct, indirect, incidental, special, punitive or consequential damages (including, without limitation, loss of use, loss of profits or revenues or other economic loss of licensee or any third party) that is claimed to have resulted from the use of the Materials, even if UN CC:Learn or the United Nations have been advised of the possibility of such damages. The use of the e-Learning courses is at the User’s sole risk. Users specifically acknowledge and agree that the United Nations and UN CC:Learn are not liable for any conduct of any Users.

  4. The UN CC:e-Learn e-Learning courses may contain advices, opinions and statements of various information providers. UN CC:Learn does not represent or endorse the accuracy or reliability of any advice, opinion, statement or other information provided by any information provider, any Users of the e-Learning courses, any other person or entity. Reliance upon any such advice, opinion, statement, or other information shall also be at the User’s own risk. Neither UN CC:Learn nor the United Nations, nor its affiliates, nor any of their respective agents, employees, information providers or content providers, shall be liable to any Users or anyone else for any inaccuracy, error, omission, interruption, deletion, defect, alteration of or use of any content herein, or for its timeliness or completeness. Neither UN CC:Learn nor the United Nations, nor its affiliates, nor any of their respective agents, employees, information providers or content providers shall be liable for any failure of performance, computer virus or communication line failure, regardless of cause, or for any damages resulting there from.

  5. As a condition of use of UN CC:e-Learn courses, Users agree to indemnify and hold harmless UN CC:Learn, its Partners, the United Nations or its Member States from and against any and all actions, claims, losses, damages, liabilities and expenses (including reasonable attorneys’ fees) arising out of the User’s use of UN CC:e-Learn including, without limitation, any claims alleging facts that if true would constitute a breach by the User under those Conditions. If the Users are dissatisfied with any Materials on the UN CC:e-Learn or the TCU, the User’s sole and exclusive remedy is to discontinue using the UN CC:e-Learn.

  6. Materials on the UN CC:e-Learn may contain links and references to third parties web sites. The linked web sites are not under the control of UN CC:Learn or the United Nations. Neither UN CC:Learn nor the United Nations are responsible for the content of any linked web site or any link contained in a linked web site. UN CC:Learn provides these links only as a convenience, and the inclusion of a link or reference does not imply the endorsement of the linked web site by UN CC:Learn or the United Nations.

  7. The User shall refrain from any conduct that would adversely reflect on the United Nations and shall not engage in any activity regarding the use of the UN CC:e-Learn which is incompatible with the aims and objectives of the United Nations or the mandate of UNITAR.

  8. In the case of UN CC:e-Learn containing bulletin boards, discussion boards, chat rooms, access to mailing lists or other messages or communication facilities (collectively, “Forums”), Users agree to use the Forums only to send and receive messages and materials that are proper and related to the particular Forum. By way of example and not as a limitation, Users agree that when using the Forums, he or she shall not do any of the following:

  1. Defame, discriminate, abuse, harass, stalk, threaten or otherwise violate the legal rights (such as rights of privacy and publicity) of others;

  2. Publish, post, distribute or disseminate any defamatory, infringing, obscene, indecent or unlawful material or information;

  3. Upload or attach files that contain software or other material protected by intellectual property laws (or by rights of privacy and publicity) unless the User owns or controls the rights thereto or has received all consents there for as may be required by law;

  4. Upload or attach files that contain viruses, corrupted files or any other similar software or programs that may damage the operation of another’s computer;

  5. Delete any author attributions, legal notices or proprietary designations or labels in any file that is uploaded;

  6. Falsify the origin or source of software or other material contained in a file that is uploaded;

  7. Advertise or offer to sell any goods or services, or conduct or forward surveys, contests or chain letters, or download any file posted by another user of a Forum that the User knows, or reasonably should know, cannot be legally distributed in such manner.

  1. Users acknowledge that all Forums are public and not private communications. Further, Users acknowledge that chats, postings, conferences, e-mails and other communications by other Users are not endorsed by UN CC:Learn or the United Nations, and that such communications shall not be considered to have been reviewed, screened or approved by UN CC:Learn or the United Nations.

  2. Upon infringement of these TCU, UN CC:Learn reserves the right to remove, any content of UN CC:e-Learn, including but not limited to, content on the Forums received from Users, emails and bulletin board postings.

Preservation of immunities

Nothing in or related to the TCU shall be deemed a waiver, express or implied, of any of the privileges and immunities of the United Nations, the Parties Members of UN CC:Learn or UNITAR under the terms of the 1946 Convention on the Privileges and Immunities of the United Nations.

Use of Your Data and Content

Issues regarding the confidentiality and security of your personal information and informed consent are detailed in our Privacy Policy, which is integral part of this Agreement.

General

No waiver by the UN CC:Learn of any provision of these TCU shall be binding except as set forth in writing and signed by its duly authorized representative.

UN CC:Learn reserves the right to modify these TCU at any time and without advance notice. Any changes to the TCU will be effective immediately upon posting on this page. By accessing the UN CC:e-Learn platform, you signify your agreement to the TCU as varied or amended with the terms of this Agreement.

The designations employed and the presentation of Materials in this Internet publication do not imply the expression of any opinion whatsoever on the part of UN CC:Learn or the United Nations concerning the legal status of any country, territory, city or area or of its authorities, or concerning the delimitation of its frontiers or boundaries. The term “country” as may be used in the Materials also refers, as appropriate, to territories or areas. The designations “developed” and “developing” regions are intended for statistical and analytical convenience and do not express a judgment about the stage reached by a particular country or area in the development process.

UN CC:Learn is a collaborative initiative involving more than 30 multilateral organizations which supports countries in designing and implementing country-driven, results-oriented and sustainable learning to address climate change. The Parties members/UNITAR represents UN CC:Learn for the purpose of this Agreement. UN CC:Learn administers all information found on the UN CC:e-learning platform.

The present Privacy Policy along with the Terms and Conditions of Use constitute an “Agreement” between the user and the UN CC:Learn regarding the use of any portion of the One UN CC:Learn e-learning platform which consists of all content located within the unccelearn.org web domain, including e-Learning courses, material, or any other services (learning products).

By registering on the UN CC:e-Learn platform, Users hereby confirm their awareness and acceptance of the present Privacy Policy and the Terms and Conditions of Use, as well as any changes or modifications to the Privacy Policy or Terms and Conditions of Use that may from time to time be implemented.

The purpose of this Privacy Policy is to explain how UN CC:Learn collects, uses and shares information about Users through the UN CC:Learn website (www.uncclearn.org), UN CC:e-Learn training platform (www.unccelearn.org) and respective e-Learning courses (hereinafter referred to as “UN CC:e-Learn”)

Personal Information

Personal information is information which Users provide to UN CC:Learn which personally identifies them, such as name, email address or other data which can be reasonably linked to them. This information is requested upon registration on the UN CC:e-Learn, and can also potentially be provided when filling feedback forms or sending an email.

Collection of Information

Data collected on the UN CC:e-Learn can be data provided by the User, i.e. upon registration, feedback form, emails, etc. OR data collected through the use of UN CC:e-Learn services, i.e. navigation, assignments, comment, and/or activity streams.

The following data2 is collected through the use of UN CC:e-Learn services for the purpose of learning analytics. Data collected will depend on the services offered for respective courses.

  1. Access log to the servers;

  2. User visits in different pages (lessons, units, assignments);

  3. User posts and comments in conversation tool;

  4. User submissions, results and comments in assignment functionality;

  5. User submissions of peer-assessment;

  6. Time spent on different activities;

  7. Anonymized user behaviour and statistics.

No individual learning analytics will be knowingly made available to other people outside UN CC:e-Learn.

Use of Information

Personal information is collected and used for the following purposes:

  1. to provide, maintain, protect and improve the quality of the UN CC:Learn, UN CC:e-Learn and all its services; this includes the implementation of quality assurance processes;

  2. to provide Users with personalised feedback;

  3. to fulfil any contractual agreements between the User and the UN CC:Learn as per Terms and Conditions of Use (link);

  4. to send the User monthly newsletter, email notifications and updates about UN CC:Learn, UN CC:e-Learn and services Users are enrolled in*;

  5. to manage User account(s).

*Users may opt out of the newsletter at any time by writing an email to the UN CC:Learn Secretariat.

Security of Information

Privacy of User information is of utmost priority for UN CC:Learn. Procedural and technological measures are in place to protect User Personal Information. Such procedures protect the confidentiality of the Personal Information or User traffic that UN CC:e-Learn creates, receives, stores and transmits.

UN CC:e-Learn has done all in its power to ensure that the Company providing the Hosting Services for UN CC:e-Learn has put in place all the requisite technical and organisational security measures to prevent unauthorised access to Users’ personal information.

UN CC:Learn protects all stored data from misuse and respects the rights of the data owners which are guaranteed by ensuring that the access, analyse or otherwise the purpose of use of information is consistent with our mandate.

UN CC:e-Learn may disclose your Personal Information only:

(a) if required to do so by law, regulation or other government authority or otherwise in cooperation with an investigation of a governmental authority;

(b) to enforce the UN CC:e-learn Terms and Conditions of Use;

(c) to protect the safety of users of the UN CC:e-Learn and its services.

Changes in the Privacy Policy

The Privacy Policy is subject to change and modification. Any change, update, or modification will be effective immediately upon posting on our website. Any material change to this Privacy Policy will be made known by changing the effective date (located at the bottom of this page). This page should be reviewed periodically to ensure Users are up to date with the most current version of this Privacy Policy.
